The meeting of the Lincoln Township Planning Commission was called to order by Chairperson Susan Ensign at 6:30 pm.

 

Roll call was taken:  Susan Ensign, Sheila Mesler, Reid Duford, Larry Surma, and Denise Schneider were all present.

 

A motion was made by Sue Ensign to approve the agenda and the motion was supported by Denise Schneider.  Motion approved 5-0.

 

Motion by Reid Duford and supported by Denise Schneider to approve the minutes of the September 1, 2009 meeting.  Motion approved 5-0.

 

A public hearing was held upon a request from F.I.T. LLC to rezone four parcels from current zoning of Low Density Residential and Business-1 to Light Industrial:

Petitioner and landowner, Keith Thurlow, and Lucas Wysong spoke in support of the request in preparations of a possible future development of this 112 acres west of Stark Rd and north of US-10. They explained that only a portion of parcel 110-035-200-651-00 would need to be M-1 Industrial and that parcel 110-035-400-180-00 would not change from its current commercial zoning.

Mr. Wysong also stated that the building design process and engineering has already commenced and would like to break ground in 18 months.

Mr. Thurlow offered an additional restriction to his request that Fuel Sales and Fireworks Storage will not be permitted on this M-1 Industrial Zoned property.

 

Sheila Mesler read Section 125.286i of the Township Zoning Act (PA 184 of 1943) �Conditions for rezoning land; offer by landowner; approval by township; time period; extension; lack of offer by landowner�

 

Mr. Wysong asked that if the commission was imposing a time frame it would be as long as possible � no less than 5 years.

 

 

 

Public Comments - 9 citizens were in attendances for the public hearing (including petitioners):

  • Kathleen Kemp of 1800 N Stark Rd

    1. Ms. Kemp stated that the subject property was surrounded by residential properties and it is not appropriate to be so close to other residential parcels on East Sanford Road. She did not want to see another Virginia Dr development with no buffers

    2. Says it is contrary to Lincoln Township�s master plan as light industrial

    3. Questioned the potential noise from barking dogs

    4. Asked about their need for city water and whether they had plans to annex to the City of Midland for the fact that the property was in the MUGA

Mr. Thurlow and Mr. Wysong responded that there are buffers, they do not have plans to annex to Midland at this time; however, they would need municipal water for this complex; and the proposed shelter would house animals inside in the evening hours, as required.

  • Elizabeth Jackson of 1695 N Stark Rd inquired about parcel 110-035-400-180-00 with its current Business-1 zoning

Mr. Thurlow responded that this parcel was not part of the request for rezoning and that there were no plans for that parcel at this time

  • Jim McCandless of 1321 E Sanford Rd said that the Planning Commission was being too restrictive and a property owner should be allowed to use their land as they wish.

  • Kim Oswald of 1061 E Sanford Rd asked if once the property is developed, can it be sold and still be industrial

Sue Ensign responded that once the property is developed, as per this request, it would stay M-1 industrial whether or not all or part of the property sold to a new owner

 

Commission Comments: The commission stated that the petitioner responded accordingly to the commission�s comments to the petitioner�s previous unsuccessful attempt to rezone the subject property. The commission determined that 5 years to commence the project was a reasonable time considering that the petitioner would have the opportunity to request time extensions if needed.

 

Larry Surma made a motion to accept the petitioner�s request for rezoning, as stated on the application for Land Use Certificate of Approval #4132 and attached letter and parcel map from petitioner, F.I.T. LLC, provided that construction of said development will commence within 5 years from the date of the Township Board�s final approval, the time period may be extended upon the application of the landowner and approval of the Township Board if needed; and furthermore, �Fuel Sales and Fireworks Storage will not be permitted on this M-1 Industrial Zoned property.� The motion was supported by Reid Duford.  Motion approved 5-0.

 

Old Business: Reviewed drafted Zoning, Existing Land Use, and Future Land Use maps that were prepared by Rowe Inc, and discussed correcting typographical errors and other types of mistakes or omissions within the current Lincoln Township Zoning Ordinance.

 

New Business: None.
